Terms of Service

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use Tagral. By using the Service, you represent that you meet these requirements and that you are legally able to enter into a binding agreement.

2. Your Account

You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access. You agree to provide accurate, current information and to keep it up to date.

3. What Tagral Does

Tagral is a tool that helps you:

• Photograph and identify garments using size-dot and image recognition.
• Look up market prices based on real resale comps.
• Draft and publish listings to third-party marketplaces you choose.
• Generate shipping labels and track sales across platforms.

Tagral is not a marketplace and is not a party to any sale you make. Every transaction happens between you and the buyer on the marketplace where the listing lives (eBay, Poshmark, Mercari, Depop, Facebook Marketplace, etc.).

4. Your Content and Responsibilities

You are solely responsible for the items you list and the content you post (photos, descriptions, prices, messages). By using Tagral, you represent and warrant that:

• You own the items you list, or have the legal right to resell them.
• Your listings are accurate and not misleading, including condition, authenticity, and size.
• Your content does not infringe any trademark, copyright, or other intellectual property right.
• You comply with the terms of service of every marketplace you cross-list to.
• You will not list counterfeit, stolen, recalled, illegal, or otherwise prohibited goods.

You retain ownership of the photos and content you upload. You grant Tagral a worldwide, royalty-free license to host, display, resize, and transmit that content solely to operate and improve the Service — for example, to draft listings, send them to marketplaces you choose, and train our identification models on anonymized, aggregated data.

5. Marketplace Rules and Cross-Listing

Each marketplace has its own rules about what you can list, how many listings you can run, how you communicate with buyers, and how cross-listing tools can be used. You are responsible for reading and following those rules. Tagral is not liable for account suspensions, listing removals, or policy violations on third-party marketplaces.

The Tagral browser extension operates inside your logged-in browser session. You remain the account holder and are responsible for every action taken through your accounts.

6. Pricing, Subscriptions, and Refunds

Tagral may offer free and paid plans. Subscription pricing, billing frequency, and included features are shown in the app before you subscribe. Subscriptions renew automatically until cancelled. You can cancel at any time through your app store or account settings; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.

7. Acceptable Use

You agree not to:

• Use Tagral to list counterfeit, stolen, recalled, hazardous, or illegal goods.
• Misrepresent the condition, authenticity, brand, or size of items.
• Scrape, copy, or redistribute Tagral's product catalog, pricing data, or software.
• Attempt to reverse engineer, decompile, or interfere with the Service.
• Use Tagral to harass, defraud, or harm other users or marketplace buyers.
• Circumvent rate limits, security measures, or marketplace policies.
• Automate account creation or use the Service with bots, scripts, or unauthorized clients.

We may suspend or terminate accounts that violate these rules, with or without notice.

8. Intellectual Property

The Tagral name, logo, website, app, extension, catalog, pricing models, and all related software are owned by Means A Lot LLC and are protected by copyright, trademark, and other laws. Brand names referenced in Tagral (such as "lululemon," "Alo," "Nike," "Vuori," or "Patagonia") are the property of their respective owners and are used for descriptive and informational purposes only. Tagral is not affiliated with, endorsed by, or sponsored by any of these brands.

9. Third-Party Services

Tagral integrates with third-party services including marketplaces, shipping carriers, payment processors, and cloud providers. We don't control those services and aren't responsible for them. Your use of any third-party service is governed by its own terms and privacy policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAGRAL DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF PRODUCT IDENTIFICATION, ACCURACY OF SUGGESTED PRICES, AND UNINTERRUPTED OPERATION. Pricing and identification suggestions are estimates based on available data and are not guarantees of sale price or authenticity.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAGRAL AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SALES, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) USD $100.

12. Indemnification

You agree to indemnify and hold harmless Tagral, Means A Lot LLC, and their officers, employees, and agents from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your listings, your sales, or your violation of these Terms.

13. Termination

You may stop using Tagral and delete your account at any time. We may suspend or terminate your account if you violate these Terms, if we're required to by law, or if we discontinue the Service. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Hawaii, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Honolulu, Hawaii, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we'll revise the "Effective Date" above and notify you through the app or by email. Continued use of the Service after changes means you accept the updated Terms.
